Child Custody and Support

Child Support Division of Texas

The Child Support Division of Texas is Texas’s child support enforcement agency. Their website offers multiple resources.  For example, you can request a calendar specifically designed to help kids track their visitation schedule.

Texas Family Code

Select the Family Code, from there select the Chapter of your interest.  If you are from another state, the above chapter list can help you find what you need to know from your State’s Family Code.

Even though we would like to do as we like, Family Law imposes limitations and rules on what can and cannot be agreed.  It also stipulates minimums (for example, the amount of support is a formula).  If needing to understand something in more detail, going to the table of contents and reading the relevant articles is enlightening.  Sections that are a must read for those that feel that information is power (from the source, not retold by your counsel):

Chapter 151.  Rights and Duties in Parent-Child Relationship.

Chapter 152.  Uniform Child Custody Jurisdiction and Enforcement Act.

Chapter 153.  Conservatorship, Possession, and Access.

Chapter 154.  Child Support.

Chapter 156. Modification (Important to know how what you agree might be modified).

Chapter 157. Enforcement.

Chapter 158.  Withholding from Earnings for Child Support.

Section 111.  Guidelines for Possession and Child Support (just an FYI, that whatever you read could change, not frequently, but it might change).

Child Support Calculator

Important note:  The calculator only applies if the person giving support doesn’t earn more than a given amount (stated at the bottom of the calculator page).  If the person earns more, then reading Chapter 154, Article 125 and 126 is helpful and something to discuss with your counsel.

This Texas government website gives a glimpse of what the Law would grant as “fair” Child Support.

Handbook for the Non-Custodial Parent

A good reference to learn the rights and obligations of such parent.
